Brothers arrested on attempted theft charges

Brothers, Anthony and John Mayberry of Holton, were arrested Saturday night after officers responded to a call that suspicious activity was taking place at a property on CR450 E. near Osgood.

According to information from Sgt. Terry Nickell of the Indiana State Police, the pair was attempting to take a dune buggy from a barn. “They had pushed the dune buggy out by the roadway,” the officer noted.

Sgt. Nickell noted that the owner of the property had asked the neighbor to be on the lookout for anything suspicious since other things had been missing from the property that has only a barn, not a residence, on it. When the neighbor saw some activity, police were called at 10:49 p.m. Saturday, March 25. ISP Trooper Ben Bastain arrived on the scene at 10:54 p.m. to discover an attempted theft in progress.

When officers initially arrived, the suspects both fled. Sgt. Nickell noted that Anthony (Toney) Mayberry was immediately apprehended. John Mayberry fled into a wooded area north of the barn and with the assistance of the Osgood Police Department was caught at 11:16 p.m. They were also assisted at the scene by the Ripley County Sheriff’s Department.
While officers were at the scene, Terri Mayberry, 38, wife of John, drove up and was arrested for operating a vehicle while intoxicated.

Anthony Mayberry, who is the Chief of the Holton Volunteer Fire Department, was suspended without pay from his position as a foreman for the Ripley County Highway Garage, per county policy.


Thankful for the tip from an alert neighbor, Sgt. Nickell concluded, “We (law enforcement) don’t do anything by ourselves. In crimes against people, we need and appreciate the public’s help.” He encouraged people to watch out for each other and report suspicious activity immediately to the police.
